Pomo Terms of Use
1. Acceptance
By downloading, installing, or using Pomo ("the App"), you agree to these Terms of Use and to the Disclaimer and Privacy Policy, which are incorporated by reference. If you do not agree, do not use the App.
2. What the App is
The App is a focus timer. It runs countdown timers you configure, and records the sessions you complete so it can show you your own history and statistics.
The App does not provide medical, health, psychological, educational, or professional advice. See the Disclaimer for the full statement.
3. Licence
Subject to these Terms, you are granted a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own non-commercial use.
You may not: copy, modify, or create derivative works of the App; reverse engineer, decompile, or disassemble it except to the extent that restriction is unenforceable under applicable law; rent, lease, lend, sell, sublicense, or distribute it; or remove any proprietary notices.
If you obtained the App from the Apple App Store, your licence is additionally subject to Apple's Licensed Application End User Licence Agreement, and to the extent of any conflict, the more restrictive terms govern your use.
4. Subscriptions and payment
The App is free to download and includes optional paid features offered through an auto-renewable subscription.
- What you get. The subscription unlocks the premium features described on the purchase screen in the App at the time you subscribe.
- Price and duration. The price and billing period are shown in the App before you confirm, in your local currency. Prices may differ by region and may change; any change will be disclosed before it takes effect and, where required by law or by Apple, will not apply to you without your consent.
- Payment. Payment is charged to your Apple Account on confirmation of purchase. All billing is handled by Apple, not by the developer.
- Automatic renewal. The subscription renews automatically at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the then-current price.
- Free trial, if offered. Where a free trial is offered, any unused portion of a trial is forfeited when you purchase a subscription. If you do not cancel before the trial ends, the subscription begins and is charged automatically.
- Managing and cancelling. You can manage or cancel your subscription at any time in Settings → your name → Subscriptions on your device. Cancelling stops future renewals; it does not retroactively cancel the current period, and access continues until that period ends.
- Refunds. Purchases are made from Apple, and refunds are handled by Apple under its own policies. The developer cannot issue, approve, or refuse refunds. Requests can be made at reportaproblem.apple.com.
- Statutory rights. Nothing in this section limits any right of withdrawal, cancellation, or refund you have under the consumer law of your country, which applies in addition to Apple's policies.
5. Content you enter
Preset names and other text you enter remain yours. They are stored only on your device and are never transmitted to the developer, so the developer neither receives, reviews, nor moderates them.
6. Intellectual property
The App and its design are owned by the developer and protected by intellectual property law.
"Pomodoro Technique" and "Pomodoro" are trademarks of their respective owner. The App is an independent timer and is not affiliated with, endorsed by, or verified by that owner. All trademarks, service marks, and trade names are the property of their respective owners; any reference is nominative and descriptive only.
7. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NO WARRANTY IS MADE THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY TIMER, NOTIFICATION, OR ALERT WILL BE DELIVERED, BE AUDIBLE, OR OCCUR AT ANY PARTICULAR TIME, OR THAT ANY DATA STORED ON YOUR DEVICE WILL BE PRESERVED.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, TIME, EARNINGS, OR MISSED APPOINTMENTS, OBLIGATIONS, OR DEADLINES, ARISING OUT OF OR RELATING TO THE APP.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE DEVELOPER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP AND ITS SUBSCRIPTIONS IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow certain exclusions or limitations, including of liability for death or personal injury caused by negligence, for fraud, or for gross negligence. In those jurisdictions these limits apply only so far as the law allows, and nothing here excludes liability that cannot lawfully be excluded.
9. Indemnity
To the extent permitted by law, you agree to indemnify and hold the developer harmless from any claim arising out of your misuse of the App or your breach of these Terms.
10. Termination
This licence ends automatically if you breach these Terms. You may end it at any time by deleting the App. Ending the licence does not by itself cancel a subscription; cancel that in your Apple Account settings as described in section 4.
11. Changes
These Terms may be updated. The current version is always posted at this URL with a "Last updated" date. Continuing to use the App after a change means you accept the updated Terms.
12. Severability
If any provision is held unenforceable, the rest remains in effect and the unenforceable provision is limited to the minimum extent necessary.
